FLOODPLAIN ZONING

The National Flood Insurance Program (NFIP) was established with the passage of the National Flood Insurance Act of 1968.   The NFIP is a Federal Program enabling property owners in participating communities to purchase insurance as a protection against flood losses in exchange for State and community floodplain management regulations that reduce future flood damages.  Cumberland County has participated in the NFIP since well before 1990.  By law, FEMA cannot offer flood insurance in communities whose regulations do not meet or exceed the minimum requirements as set by state code for the NFIP.

 The basis of our Floodplain ordinance is the flood hazard data provided to us from FEMA.  FEMA identifies flood hazards nationwide and publishes and periodically updates this data in support of the NFIP.  Flood hazard data is provided to localities in the form of a Flood Insurance Rate Map or FIRM, and a Flood Insurance Study report, or FIS. 

 The FIRM and FIS report provide localities with information needed for land use planning and to reduce flood risk to floodplain development and implement other health and safety requirements through codes and regulations.  Each time FEMA provides us with additional data, we must update our ordinance.  

 Over the past few years, FEMA has conducted studies and reviews of our Floodplain data, and on April 14, 2022, provided the County with a draft updated FIRM and FIS.  This new data did not reflect any significant map changes, however, there are textual changes in our ordinance that were required to ensure we are in compliance with the NFIP regulations.  On  April 9, 2024, the Board of Supervisors adopted Code Amendment CA 24-01, amending Chapter 74, Article XXI, Floodplain Zoning, updating the Ordinance and bringing it into Compliance with FEMA standards.  Please see the links below for additional information.
